Why not all books by Patrick O'Brian Kindle yet? Are they short term?

I recently received a Kindle and was very surprised when I could not finish the Aubrey-Maturin series in it (I'm in the book 18). I have cheap copies of the rest series, but really want to read on my Kindle. Only one case of Amazon is slow or there are legal issues that hold them appearing on Kindle?

The editor agrees with this that the book is in Kindle format first. I think earnings will be handheld and Kindle are different.
